Providing dispute resolutions for a variety of legal matters.
Mediation is best used when the parties involved in a dispute are empowered to reach a mutually acceptable agreement, circumventing the need for extensive and costly litigation. An important part of the process is that what is said during a mediation remains confidential; only the outcome, if needed, is made public. The goal of mediation is to reach a mutually satisfactory outcome that will be honored by both parties going forward.
The Mediation process involves a mediator facilitating discussions between both parties involved in a dispute, with the end goal of reaching a voluntary and binding resolution. The involved parties are free to convey the basis of their dispute in a confidential setting, and as needed, in private caucuses with the mediator. After an agreement has been reached, the mediator takes steps to ensure both parties will honor the terms of the resolution.
The mediation process helps people resolve a variety of disputes quickly and peacefully. Because the process is voluntary and confidential, no one is forced into an agreement. Resolutions are instead created by design, giving both parties more control over the outcome of a litigation. Parties are able to emphasize terms they feel are most important to resolving their dispute, which can then be negotiated in a respectful environment overseen by the mediator.
Mediation can be preferrable to litigation because of the benefits it brings the parties involved. Disputes resolved through mediation offer more flexibility, with meetings being scheduled at the convenience of the parties involved rather than at the discretion of the court.
